The time between the Brazilian government signing an international trade treaty and it being published in the Official Gazette of the Union is, on average, 1,590 days, or four and a half years. This is what a survey by the National Industry Council shows, which analyzed 27 agreements signed by the country between 2003 and 2017. Nine of these are still in progress and have not entered into force. For the entity, “the period is too long for the productive sector to benefit from the agreements”, which usually deal with free trade, taxation and free investment.

He complains that it is “practically impossible” to monitor the progress of agreements in the Executive. There is no transparency or means to see the progress of the process over the internet, as the Executive and Judiciary allow, says the executive.



Another problem highlighted by the CNI is that of agreements that have a deadline to enter into force. A treaty signed this year will only be published in 2022. But if it has a ten-year deadline for adapting institutions, Brazil will only take advantage of its clauses in 2032.

Extreme cases
The CNI cites examples. The most glaring is an agreement between Brazil and Russia to avoid double taxation on certain products. According to the survey, the agreement took 12 years and 11 months to be enacted. One of the problems was that Congress had to discuss it twice, because the Executive sent the text without one of the pages in the annex. An agreement between Brazil and Venezuela took nine years and 11 months to be promulgated.

Another emblematic case is the Mercosur-Sacu (Southern African Customs Union) Preferential Trade Agreement. It was signed in April 2009, but the Civil House only sent the text to Congress in April 2010. The agreement was approved, but Itamaraty found more than 200 English translation errors after approval. The document returned to Congress and only came into force on April 4, 2016. In Uruguay, the text was promulgated in September 2011.
